The facts in Fisher Meredith v JH and PH (Financial Remedy: Appeal: Wasted Costs) [2012] EWHC 408 (Fam) [2012] All ER (D) 157 (Mar) are the stuff of nightmares. Two working days before a five-day trial, new evidence is served. There is no option but to adjourn the hearing. The adjournment is granted. Not only is a costs order made against your client but a wasted costs order is made against your firm for not earlier applying to join relevant third parties.  In this appeal, Mostyn J gives useful guidance as to the correct approach to the involvement of third parties in applications for a financial remedy.

The Family Procedure Rules 2010 (FPR 2010) have introduced a change in the terminology in divorce proceedings. There are however some inconsistencies between the terminology used in the rules, which use the new terms, and those referred to in the forms which refer to old terms. Divorce proceedings are referred to as matrimonial proceedings.

To gauge the effect of the Family Procedure Rules 2010 (FPR 2010), family lawyer organisation Resolution commissioned a member survey that generated responses from users of over 100 courts across England and Wales and highlighted a wide range of experiences of the mediation information and assessment meetings (MIAMs) introduced by the FPR 2010.

Cafcass has released the latest statistics regarding the issue of care proceedings which indicate that applications remain at a very high level. Between April 2011 and March 2012, Cafcass received 10,199 new applications. This figure was 10.8% higher when compared to the same period in the last financial year. Applications received between May 2011 and February 2012 this year have been the highest ever recorded by Cafcass for these individual months.
