advice please 2 Months, 3 Weeks ago
hi all

i am new here so i hope i am in the right place.

bascially 5 years ago my partner got full residence of his son, due to his mother being unfit to care for him.

last year proceedings were re started and the mother underwent hairstrand testing,

the judge allowed the mother unsupervised overnight contact with her son once every 2 weeks. ( this for the past 5 years has been supervised.

however more recently another hairstrand test was order by the judge due to some evidence that had been received stating that the mother had been taking pills and amphetamine.

the mother openly admitted in court that she had also been smoking more cannabis than usual.

however the hairsrand results have come back negative.

so i was wondering what to do next, i am hpoing that the judge will pick up on the fact that she stated she was smoking more cannabis but yet none has come back.

personally i find this a little strange

any help for my next step of action would be much appreciated

Could your partner's legal representative make this point, or could he submit a letter to the court as the child's guardian, making the point that the mother has stated she was smoking more cannabis than usual even though the strand was negative?

At the end of the hair strand report it usually says that the results should not be viewed in isolation or be seen as conclusive. Her own evidence should be raised and tested, perhaps she should be directly questioned about her admission and asked to submit a statement about the history of her drug abuse. If the matter goes to final hearing she could be cross examined about it.
