50-50 9 Months ago  
hello - my charming husband is divorcing me. I've been told that in the UK all assets are split 50-50. is this true? Is that just income? What about houses and property? I haven't spoken to a lawyer yet. Who's the best? Can anyone recommend one? I need a good one.

The 50-50 split is not strictly true, although the courts are often more favourable to wives in England than abroad.

Resolution is a national organisation of family lawyers, and will be able to point you in the direction of a good divorce lawyer. You can also use lawyerlocator, a website which allows you to search for the best lawyer for you. www.lawyerlocator.co.uk.

It's a bit more complicated than 50-50, I'm afraid.

You will be entitled to ancillary relief and a share of property, pensions etc.

A lawyer can advise you further. Try Resolution or the Law Society for a list. Most law firms have websites with brief CVs of their solicitors.

For divorce where the couple are married, then a split of 50-50 is indeed in the norm.

However, as many assets cannot be directly split, often a period of negotiation is required by which both parties become satisifed that the sum of assets have been shared on a roughly 50-50 basis - as required.

50:50 is a starting point. There are lots of factors that the court take in to account when deciding in which direction to move the scale. There is a fundamentle principle of sharing and English Courts are one of the very rew jurisdictions where a no fault approach is taken ( unless there are exceptional circumstances) and the ultimate goal is to achieve a fair result.

Your lawyer should negotiate a fair settlement for you using similar principles and hopefully keep you out of court
