In the April issue of BFLN we considered the impact of delay as a key factor in the then awaited judgment in Vaughan v Vaughan [2010] All ER (D) 04 (Apr) (See BFLN April 2010 – Blast from the past). With the judgment now handed down by the Court of Appeal in Vaughan it has emerged that another key focus of the Court of Appeal was the issue of the second wife and her “hypothetical” claims.
