The Matrimonial Causes Act 1973 (MCA 1973) sets out the grounds on which a marriage is void or voidable and the bars preventing the grant of a decree of nullity. Proceedings for nullity are rare but may be appropriate where clients have strong religious and or cultural reasons for not wishing to divorce.

nullity is indeed important in the cases where the parties are required to go
through religious marriage veremony before they start living together as
husband and wife. Decree of Nullity enhances the girls prospects of future
marriage which are normally prejudiced with the decree of divorce. I view though
Nullity is rare but whenever used it is effective.

In my experience, persons seek to have a marriage declared void or voidable
where the necessary grounds exist ie fraud, mistake, mental illness, already
married and domiciled here, non consummation etc and I have found their reasons
for wanting nullity rather than divorce are often because they want to be free
to remarry as soon as possible and do not want to be seen to be "at
fault" for the breakdown of the marriage. Religion often has had little to
with it.
