Court of Appeal states Hildebrand rules no defence to an injunction Print E-mail

The Court of Appeal has held in Imerman v Tchenguiz and others [2010] All ER (D0 320 (Jul) that the guidelines set out in Hildebrand v Hildebrand [1992] 1 FLR 244 (commonly referred to as the ‘Hildebrand rules’) regarding the taking or copying of another party’s documents have no legal basis in “selfhelp” cases save in restricted circumstances.

The Ministry of Justice has issued a consultation on whether to close 103 magistrates’ and 54 county courts that they state are “underused and inadequate” in England and Wales.
